EMS offers information and a
means to obtain services offered by Manager of Your Estate (MOYE)
, WORKER's, which may be requested through Mobile SMS, Website,
the use of an application supplied by EMS and downloaded and
installed by you on your single mobile device (smart phone) (the
Application) or through any other channel made available by EMS
for ROS purposes. All services provided by EMS are hereinafter
referred to as the Service.

These terms and conditions ("User Terms") apply to your visit to and your use of the website and Services at www.estatemanservice.com (the "Website") whether through a computer or a mobile phone, the Service and the Application (as defined below), as well as to all information, recommendations and or services provided to you on or through the Website, the Service and the Application. For the purposes of this User Terms, "EMS" shall mean EstateMan Services. "You" and "your" means a person who meets the eligibility criteria set out below.
PLEASE READ THESE USER TERMS CAREFULLY BEFORE DOWNLOADING THE APPLICATION AND/OR USING THE SERVICE AND WEBSITE.
EMS offers information and a means to obtain services offered by Manager of Your Estate (MOYE) , WORKER's, which may be requested through Mobile SMS, Website, the use of an application supplied by EMS and downloaded and installed by you on your single mobile device (smart phone) (the "Application") or through any other channel made available by EMS for ROS purposes. All services provided by EMS are hereinafter referred to as the "Service".
AGREEMENT BETWEEN EMS AND YOU
By using the Service, you enter into a contract with EMS (the "Contract"). In order to be able to use the Service, you first need to read and accept the terms and conditions on the website. If you reside in a jurisdiction that restricts the use of the Service because of age, or restricts the ability to enter into contracts such as this one due to age, you must abide by such age limits and you must not use the Service.
HOW TO USE THE SERVICE
The service allows you to send a
request through EMS to a MOYE in EMS network. The MOYE has sole
and complete discretion to accept or reject each request for
service. If the MOYE accepts a request, EMS notifies you and
provides information regarding the MOYE - including worker name,
EMS shall procure reasonable efforts to bring you into contact with a MOYE in order to obtain service, subject to the availability of worker.
For the avoidance of doubt: EMS on its own does not provide Estate services, and EMS is not a MOYE. It is up to the MOYE to offer Estate Services, which may be requested through the use of Mobile sms/website/app. EMS only acts as intermediary between you and the MOYE. The provision of the Estate services by the MOYE to you is therefore subject to the agreement (to be) entered into between you and the MOYE. EMS shall in no event be made a party to such agreement.
YOUR USE OF THE SERVICE
Our Services are available only
in estates registered with us. You warrant that the information
you provide to EMS is accurate and complete for the information
requested by the respective channel of service. EMS is entitled
at all times to verify the information that you have provided and
to refuse the Service or use of the Application without providing
reasons. You may only access the Service using authorized means.
EMS will not be responsible for any loss, damage or disruption of
service due to error in data provided at the time of Service
You may sms to our call center no 8696828200. EMS shall endeavour to responds to your sms and cater to your requirements. Nevertheless EMS does not assure a response at all times due to the dependency on the call/sms handling capacity which is variable in nature. By service request via mobile sms, you also agree to the terms and conditions governing the service (go to www.estatemanservice.com for detailed T&C). EMS will store the information provided for contacting you for all service related matters. You may promptly inform EMS on any change in the information provided, in order to serve you better.
Service request via website: You may place a ROS through our website www.estatemanservice.com. It is mandatory to register with a valid mobile number and e-mail at the time of first booking. By signing up, you also agree to the User Terms governing the site. EMS will store the information provided for contacting you for all service related matters. You shall promptly inform EMS on any change in the information provided, in order to serve you better.
Bookings via Mobile Application: You may download EMS application on your device for availing the Service. By downloading the Application, you also agree to the User Terms. EMS will store the information provided for contacting you for all service related matters. You may promptly inform EMS on any change in the information provided, in order to serve you better.
It is your responsibility to check to ensure you download the correct Application for your device. EMS is not liable if you do not have a compatible mobile device or if you download the wrong version of the Application for your mobile device. EMS reserves the right to terminate the Service and the use of the Application should you be using the Service or Application with an incompatible or unauthorized device.
By using the Application or the Service, you further agree that:
You will only use the Service or download the Application for your sole, personal use and will not resell it to a third party. You will not authorize others to use your account. You will not assign or otherwise transfer your account to any other person or legal entity. You will not use an account that is subject to any rights of a person other than you without appropriate authorization. You will not use the Service or Application for unlawful purposes, including but not limited to sending or storing any unlawful material or for fraudulent purposes. You will not use the Service or Application to cause nuisance, annoyance or inconvenience. You will not impair the proper operation of the network. You will not try to harm the Service or Application in any way whatsoever. You will not copy, or distribute the Application or other EMS Content without written permission from EMS. You will keep secure and confidential your account password or any identification EMS provides you which allows access to the Service through any booking channel. You will provide EMS with whatever proof of identity EMS may reasonably request. You will only use an authorized network to avail of the service. You are aware that when requesting transportation services by SMS if available in your jurisdiction), standard messaging charges will apply. You will not use the Service or Application with an incompatible or unauthorized device. You will comply with all applicable law from your home nation, the country, state and/or city in which you are present while using the Application or Service.
EMS reserves the right to immediately terminate the Service and the use of the Application should you not comply with any of the above rules.
CONFIRMATION OF BOOKING
EMS shall, upon receiving the ROS
from you in the manner set out above, proceed to confirm or
decline the ROS based on the availability of WORKER. In the event

Payment for the services rendered to the residents of the Estate shall be made by the MOYE of the Estate as per the terms and conditions agreement signed (between EMS and Estate resident society) at the time of start of the service.
You may, upon availing or attempting to avail the Services, receive messages in your registered mobile phone from EMS regarding the following: (i) confirmation of ROS (ii) EMS declining your ROS; (iii) providing WORKER details. However, the above list is not exhaustive in nature and you may receive additional and different messages from EMS. You hereby understand, agree and give consent to the receipt of such messages from EMS.

Services (the "Company/Firm", "we", "EMS", or "us"). This Privacy
Policy explains how we collect, use, share and protect
information about you. We also provide information regarding how
you can access and update your information and make certain
choices about how your information is used.
1. WHAT INFORMATION DO WE COLLECT?

We may ask you to provide us with certain categories of information such as personal information, which is information that could reasonably be used to identify you personally, such as your name, e-mail address, and mobile number ("Personal Information"). We may collect this information through various forms and in various places through the Services, including account registration forms, contact us forms, or when you otherwise interact with us. 2. USE OF INFORMATION COLLECTED
Our primary goal in collecting
your Personal information or Usage Information is to provide you
with an enhanced experience when using the Services.
Based upon the Personal Information you provide us when registering for an account, we will send you a welcoming SMS to verify your username and password. We will also communicate with you in response to your inquiries, to provide the services you request, and to manage your account. We will communicate with you by email, telephone, or SMS or text message.
We use your information to closely monitor which features of the Services are used most, to allow you to view your service history, view any promotions we may currently be running, rate services, and to determine which features we need to focus on improving, including usage patterns and geographic locations to determine where we should offer or focus services, features and/or resources. We use the information collected from our Mobile Application so that we are able to serve you the correct app version depending on your device type, for troubleshooting and in some cases, marketing purposes.
We use your Internet Protocol (IP) address to help diagnose problems with our computer server, and to administer our web site(s). Your IP address is used to help identify you, but contains no personal information about you.
We will send you strictly service-related announcements on rare occasions when it is necessary to do so. For instance, if our Services are temporarily suspended for maintenance, we might send you a sms /email. Generally, you may not opt-out of these communications, which are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your account.

We use third party companies and individuals to facilitate our Services, provide or perform certain aspects of the Services on our behalf such as worker/serviceman and companies they work for to provide the Services, and other third-parties to host the Services, design and/or operate the Services features, track the Services analytics, process payments, engage in anti-fraud and security measures, provide customer support, provide geo-location information to our workers, enable us to send you special offers, host our job application form, perform technical services (e.g., without limitation, maintenance services, database management, web analytics and improvement of the Services features), or perform other administrative services. We may provide these vendors with access to user information, including Personal Information, this information sharing is limited to only the information needed by the vendor to carry out the services they are performing for you or for us. Each of these vendors is obligated not to disclose or use Personal Information for any other purpose.
